Please read the following terms and client agreement carefully before enrolling in any physical activity, diet, or nutrition consultation programs.

Client Agreement

Parties & Operational Overview

This Client Agreement is entered between you, as a Client of Mr. Nikhil Garg and Fusionveda Biolabs Private Limited, which is a health and wellness consultation service provider company that runs as a remote online consultation program.

Fusionveda Biolabs Private Limited offers physical activities, diets, and nutrition consultation for remission of type 2 diabetes clients online. Mr. Nikhil Garg operates the physical activities & diet plan. The following terms apply to its services and may be further revised without notice through changes made herein from time to time.

Binding Agreement

Acceptance of Terms & Waiver of Claims

PLEASE READ THE FOLLOWING TERMS CAREFULLY BEFORE ENROLLING.

By enrolling for the services offered by Fusionveda Biolabs Private Limited, or by agreeing to these terms where the option is made available to you, you signify your agreement and unequivocal, unconditional consent to these TERMS, as well as agree to waive any and all claims against Fusionveda Biolabs Private Limited or its Directors Mr. Nikhil Garg & Mrs. Neeru Gupta and its employees arising out of your use of the Diet Programs or any services therein. If you do not agree, you may not use the services.

Fusionveda Biolabs Private Limited may, at any time, modify these Terms/this Agreement without prior notice and your continued use of this program shall be conditioned upon the terms and conditions in force at the time of your use.

Service Scope

Consultation, Customization & Fee Structure

Fusionveda Biolabs Private Limited offers physical activities and diet consultancy customized for your specific needs and health goals for type 2 diabetes. Mr. Nikhil Garg shall provide consultation and recommendations based on the information provided by you.

Such suggestions and regimes shall be provided on a chargeable basis which shall be non-refundable after trial period of one month.
Fusionveda Biolabs Private Limited reserves the right to revise such charges/fees from time to time with dynamic pricing.
Fusionveda Biolabs Private Limited and Mr. Nikhil Garg shall not be obliged to provide any services otherwise than in compliance with applicable laws.
Any advice/regimen/diet provided shall depend solely on the accuracy of the information provided by you, including certified lab reports.

Any fees/charges paid by you for any services are non-refundable. Please refer to our Refund Policy for condition-specific exceptions and clarifications.

Program Rules

MALT369 Schedule, Pauses & Hold Policy

Once you sign up for a program/plan for a specific duration/phase under MALT369, you are required to start the same within the duration mutually decided by you and Mr. Nikhil Garg.

Pre-Start Hold Option (Up to 4 Weeks)

In case of any emergency or unforeseen circumstances where you are unable to start, you shall get an option to hold the plan for a maximum of 4 weeks from the date of payment, provided the same is communicated in writing via email and/or WhatsApp to Mr. Nikhil Garg. The decision will be taken by Mr. Nikhil Garg on the validity of the reason.

Non-Pauseable Situations

Please note that pauses and stoppages of the program on account of minor flus, infections, fevers, vacations, conferences, etc. will not be accounted for in the program duration. To further clarify, all such days will be included in the active program duration.

Medical Emergency Hold (Up to 10 Days)

Upon receiving the plans tailored personally for you, if there is any serious medical emergency or mishap, you shall have an option to hold the plan for a maximum period of 10 days.

Commitment, Expectations & Best-Effort Care

At Fusionveda Biolabs Private Limited, we work with the best effort after understanding your physical health and fitness goals. However, we do not guarantee any particular progress in terms of remission of type 2 diabetes in any particular period of time. Further, no particular result is unconditionally guaranteed.

Daily Interaction

Consultant Access, WhatsApp & Daily Logs

  • Confidentiality: Fusionveda Biolabs Private Limited keeps all your information confidential. Anything shared or posted on social platforms is done solely after your prior consent.
  • Access Hours: Access to Nikhil Garg is available on most days from 2:00 PM to 6:00 PM IST on WhatsApp. He will reply to all queries; please note there could be a response window from a few hours up to 24 hours.
  • Consultation Calls: You can additionally request a call as per your needs, and a slot will be fixed within 48 hours.
  • Unavailability Notice: Mr. Nikhil Garg may not be accessible (without prior intimation) due to illness, emergencies, or travel. He will always endeavour to inform you of the same in advance.
  • Mandatory Daily Logs: As part of the process and accountability, you are required to maintain all food, activity, and sleep logs as mandated by the program on the advice of Mr. Nikhil Garg. Maintenance of this online log is strictly non-negotiable and remains solely your responsibility.

Client Obligations

Client Representation & Warranties

You represent and warrant that:

You are of sufficient legal age to create binding legal obligations for any liability you may incur as a result of using our programs and services.
You are responsible for maintaining the confidentiality of our proprietary methods, recommendations, and communications as part of strict information non-disclosure.
You agree to accept full responsibility for all activities that are designed as per the information and health records provided by you.

Legal Jurisdiction

Indemnity, Governing Law & Arbitration

Indemnity

You agree to defend, indemnify, and hold Fusionveda Biolabs Private Limited and Mr. Nikhil Garg harmless from and against any claims, actions, or demands, liabilities, and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms of Use.

Governing Law and Jurisdiction

This Agreement is governed by and is to be construed in accordance with the laws of the Republic of India. Any suit, action, or proceeding seeking to enforce any provisions of, or based on any matter arising out of or in connection with this Agreement or the transactions may be brought in a court sitting in New Delhi, India, and each of the Parties hereby consents to the non-exclusive jurisdiction of such courts.

Arbitration

In case of any dispute or difference arising out of or connected with or relating to this Agreement/these terms, the same shall be referred to arbitration under the Arbitration and Conciliation Act, 1996 or any statutory modification or re-enactment thereof for the time being in force. The arbitration shall be referred to one arbitrator who will be appointed by Fusionveda Biolabs Private Limited and Mr. Nikhil Garg. The venue of Arbitration will be New Delhi, India.
